2. Description of Service

2.1 Service Overview

HiThere lets you build a personal page, a CV and a link in bio, publish them at your HiThere address or on a domain you own, and edit them yourself, with the in-app AI assistant, or with an AI assistant you connect. The specific features, capabilities, and limitations of the Service may vary based on your plan or purchase.

2.2 Service Modifications

We reserve the right, at our sole discretion, to:

Modify, update, or discontinue any aspect of the Service at any time
Add or remove features, functionality, or content without prior notice
Impose limits on certain features or restrict access to parts or all of the Service
Perform scheduled and unscheduled maintenance that may result in service interruptions

We will endeavor to provide reasonable notice of material changes that significantly impact your use of the Service. However, we are not obligated to maintain, support, upgrade, or update the Service, nor to provide any specific content.

2.3 Service Availability

While we strive to maintain high availability, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided on an "as is" and "as available" basis.

3. User Obligations and Acceptable Use

3.1 General Obligations

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and third-party rights.

3.2 Prohibited Conduct

You expressly agree not to engage in any of the following prohibited activities:

Illegal Activities:

Using the Service for any purpose that violates applicable local, state, national, or international laws or regulations
Engaging in any activity that constitutes fraud, identity theft, or money laundering
Promoting, facilitating, or engaging in illegal gambling, drug trafficking, or other criminal enterprises

Distributing content depicting violence, exploitation, or abuse
Engaging in cyberbullying, stalking, or harassment of other users

Intellectual Property Violations:

Infringing upon or misappropriating any copyright, trademark, patent, trade secret, or other proprietary right
Distributing pirated software, media, or other copyrighted materials
Circumventing, disabling, or otherwise interfering with digital rights management measures

Technical Abuse:

Attempting to gain unauthorized access to our systems, servers, or networks

Using automated scripts, bots, or crawlers to access the Service without authorization

Platform Abuse:

Creating false identities or impersonating any person or entity
Interfering with other users' access to or enjoyment of the Service
Reselling, redistributing, or providing access to the Service to third parties without authorization
Using the Service to send unsolicited communications, spam, or chain letters

3.3 User Content Standards

If you submit, upload, or transmit any content through the Service ("User Content"), you represent and warrant that such content:

Is original to you or you have obtained all necessary rights and permissions
Does not infringe any third-party intellectual property or proprietary rights

3.4 Content Monitoring and Removal

We reserve the right, but not the obligation, to monitor, review, edit, or remove any User Content at our sole discretion. We may remove content that we determine violates these Terms or is otherwise objectionable without prior notice.

Anyone can report a page with the "Report" link on it. We review reports and may suspend a page that breaks these Terms; a suspended page stops showing to visitors until we restore it. If you think we got it wrong, contact us.

3.5 Your Page, Name and Domains

Page names: your page name (the part after https://hithere.im/) must not impersonate someone else or a brand you do not represent. Some names are reserved. We may take back a name used to impersonate or infringe. A name you release is held for 12 months before anyone else can claim it.
Custom domains: connect only domains you own or are allowed to use. You keep the domain; you are responsible for its registration and DNS. If a domain stops pointing to HiThere, or your plan no longer includes it, it is released from your page.
Verified revenue: connect only a Stripe account you are authorised to connect. Figures shown as verified come from Stripe, read with a read-only key; you must not try to make them misleading. We may remove a project from the leaderboard if its figures look manipulated.
Public listings: your published page is public. Explore and the leaderboard list it only if you turn that on.
AI output: the AI assistant can make mistakes. Check what it writes before you publish; you are responsible for what appears on your page.

4. Plans, Purchases, and Fees

4.1 Subscription Terms

The Service may be offered through various plans, which may include free tiers, paid subscriptions, one-time purchases, or lifetime access options. The specific terms, pricing, and features of each plan are described on our pricing page.

4.2 Payment Terms

For paid plans, you agree to pay all applicable fees in accordance with the pricing and billing terms in effect at the time of purchase. All fees are:

Stated in the applicable currency as displayed during checkout
Due in advance for the billing period or purchase type selected
Non-refundable as detailed in our Refund Policy

4.3 Billing and Renewal

Automatic Renewal: If you purchase a recurring subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period.

Payment Processing: All payments are processed through our third-party payment processor(s). You agree to be bound by the terms and conditions of the applicable payment processor.

Failed Payments: If we are unable to process payment, we may suspend your access to paid features until payment is successfully processed. We reserve the right to terminate accounts with persistent payment failures.

We may modify our pricing at any time. For existing customers with recurring subscriptions:

We will provide at least 30 days' advance notice of price increases
Price changes will take effect at the start of your next billing period following the notice
Continued use of the Service after a price change constitutes acceptance of the new pricing
If you do not agree to a price change, you may cancel your subscription before it takes effect

4.5 Taxes

All fees are exclusive of applicable taxes (including but not limited to VAT, GST, sales tax, and withholding tax) unless otherwise stated. You are responsible for paying all taxes associated with your purchase.

In compliance with applicable trade sanctions, export controls, and international regulations, we do not offer paid services to users located in, or nationals of, the following countries and regions:

Belarus
Cuba
Iran
North Korea
Russia
Syria

United Kingdom and Crown Dependencies: we do not sell paid plans, credits, add-ons or any other paid offering to customers in the United Kingdom, the Isle of Man, Jersey or Guernsey. You may use the free plan from anywhere. We check your location, billing address and card before and after payment; if a payment from these places reaches us anyway, we refund it in full and cancel the paid plan or purchase.

We may update these lists at any time to comply with legal requirements. Users from restricted regions may not purchase subscriptions, credits, or other paid offerings. Attempting to circumvent these restrictions (including via VPN or misrepresenting your location) constitutes a violation of these Terms and may result in immediate account termination without refund.
